fighting and annexions

This is not really a bug, but an annoying behaviour of the game:

My neighbour Hercules is invading me with a lot of little armies to take as much land as possible, and my tactic is to send some big armies to kill his armies. The problem: and annexion is always taking into account by the server, but less than 1/3 of my attacking orders are made by the server. This result in a big mess as Hercules is annexing my lands even if i've a big army on it if the attack order is missed!
Can someone give me a tip to clear this problem, by telling me for example how i can be sure my attack will be taken into account?
