Please read this information carefully. By installing, updating and using this software you accept the licence terms set forth below. License As to the conditions described below, Eternity-Software-Entertainment grants you the non-exclusive, non-transferable right, to install and use the TalesOfTamar software. Only the recording medium will be subject of your property. All rights not specifically granted under this agreement, including property rights of the software and handbooks, are reserved by Eternity-Software-Entertainment. The use of this software including online use, will be regulated by this contract. License conditions Eternity-Software-Entertainment grants you the right to install this software to the hard drive of a single computer. You are not entiteled to install TOT software on several computers at the same time. You have the right to make one copy for backup purposes, assuming that you also copy the copyright- and ownership data, that are on the original CD. Installation on a network (server) is not permited, except as otherwise specifically provided by the licensor. You are not permited to sell, lease or otherwise offer this software to a third party. With the termination of this license agreement you must destroy all backup copies and hard drive components of TOT. You agree not to: Reproduce, decompile, reverse engineer, modify, adapt, translate, disassemble, derive source code and develop fully or partly modified products based on TOT software and its utilities. Violating these conditions, will terminate this contract instantly. The user agrees not to transmit any illegal or unlawful contents in text or picture, or other subjects or commercial advertisement for products or programs of third parties, especially in connection with the online function. Limited Warranty Eternity-Software-Entertainment warrants, that the recording medium will be free of defects in material and workmanship, normal use presumed, for a 90 day period from the date of purchase (presentation of original receipt). In this case Eternity-Software-Entertainment will replace the defective product free of charge, or the purchaser will receive a recompensation, limited by the price of the product. This warranty shall not be applicable and shall be void if the defect has arisen through abuse, mistreatment or neglect, with or without purpose. This warranty is only applicable within the framework of existing legislation. Guarantee waiver Except as set forth above, this warranty is in lieu of all other warranties. In no event will Eternity-Software-Entertainment be liable for misperformance or malfunction of the program including patches and virus seizure of the software and its materials. The licensor does not represent, that TOT software functions in a multiuser environment and meets your expectations. The user takes the full risk, that results from using this software. Comments and advises of the manufacturer, his assistents, distributors, representatives or contractors, will not create a different or extended warranty. Disclaimer Eternity Software Entertainment will only be liable for damages, that are caused by premeditation or gross negligence. Further legal liabilities will be without prejudice of any claim. Liability will be excluded in any case for: Loss of data, malfunction of the software, results from illicit action and manipulation, virus seizure, unauthorized access to data, damage of hard- and software also in context with the online function, personal damage, disturbances of business transactions, loss of business information, all financial losses, caused by using or unusuality of this software or its online functions and for forcemajeure. Liability will also be precluded for technical problems and malfunctions of computer online systems, online providers, servers, and computer accessories in combination or as a result using this software. Terms of payment Prices mentioned in the price information include 16% VAT. Recompensation of already paid fees, in the event of premature termination, will be precluded. Payments have to be made immediately. If you choose direct debit mandate, Eternity-Software-Entertainment is entitled to draft fees directly from your bank account, until revocation. Therefore we need your personal data, especially bank account data. If a debit entry is rejected, the costs of cancelation are paid by the user (generally Euro 8.-). For outstanding debits we quote 5% above the usual interest rate. Server access will be closed. The User assures that all data, especially name, adress, telefon number and bank account number and -routing are correct and complete. Changes have to be reported right away. Data security The user knows, that data transfers via internet are not always safe. According to the stand of technology, there is no absolute data security. The user takes the full risk. The licensor will handle customer data confidential and will not transfer them to third party. Termination Without prejudice of other rights of Eternity-Software-Entertainment, this agreement will terminate automatically, if the user fails to comply with its terms. In such event the user must destroy all copies of TOT and eliminate all component from the hard drive. Legislation This agreement is amenable to the laws of the Federal republic of Germany. If any provision of this agreement is held to be unenforceable for any reason, such provision shall be reformed only to the extent necessary to make it enforceable and the remaining provisions shall not be affected.
